Unfortunately even persons newly arriving to the Atlanta area may find themselves immediately faced with legal problems. Two of the most common legal matters are getting stopped or questioned by the police, and filing or enforcing family law matters. Dealing with the legal system can seem like a scary prospect; but it doesn’t have to be. It is important to know your rights and responsibilities. The following are a few basic pointers. Criminal Law If you are ever stopped by the police, remember the following rules: - You should always cooperate with the requests of the police. - If pulled over while driving, remain in your car unless you are asked to step out, or get permission to do so. - Do not give excuses or explanations (it is ok to remain “silent”). - The police do not have an automatic right to search your vehicle – you can say “No”. - You have the right to an attorney, even if you cannot afford one… JUST ASK. Family Law Family Law includes divorce, alimony, child support, and child custody/visitation. If you are dealing with a Family Law matter, you should know: - If you were granted alimony or child support in another state, you will need to file it with the Georgia courts (in your county) immediately. - To file new matters (divorce, requests for support/custody, etc.), you must have lived in your current county for at least six (6) months. - If you are a father who was not married to your child’s mother at his/her birth, you will have to “legitimate” your child before you have the right to custody/visitation.
